Is Harm Ever Irreparable?

Abstract

In this lecture, I wish to address the remedies available to an injured party who seeks redress for what he alleges is an ongoing injury arising from the unauthorized use of his property by another. Broadly speaking, that injured party is entitled to damages or an injunction. One requirement for receiving either a preliminary injunction or a permanent injunction is a showing of irreparable harm. The question I wish to pose is this: In the context of commercial business disputes, is harm ever irreparable?
