FTC Releases Report on Broadband Connectivity and Net Neutrality; Cites Sidak Extensively

The FTC today released a study discussing the findings of the Internet Access Task Force formed by FTC Chairman Deborah Platt Majoras in August 2006. The report, titled “Broadband Connectivity Competition Policy,” focused on broadband Internet connectivity and more specifically network neutrality as developed from the two-day public workshop on broadband connectivity held in February 2007 and from FTC and Task Force research. The report relies heavily on the papers and opinions of Criterion Founder J. Gregory Sidak, citing him 28 times.
The report recommends that policy makers “proceed with caution in the evolving, dynamic industry of broadband Internet access, which generally is moving toward more—not less—competition.” The report notes that certain business arrangements that broadband providers may pursue, including data prioritization, exclusive deals, and vertical integration into online content and applications, can benefit consumers. Thus, the report finds that unless there is significant market failure or demonstrated consumer harm, policy makers should refrain from enacting any new regulation in this area.
